- In accordance with state regulations, all employees are required to take rest breaks as allotted based on hours worked. Refer to the table below for details.
- Hourly employees must clock in and out for all rest breaks. At no time should an employee be away from their work post and not clocked off. Salaried employees are not required to clock in or out and are exempt from meal & rest break requirements in accordance with State law.
- For floor staff, breaks will be scheduled, and you will be relieved of duties by a designated staff member. The timing of your break may vary depending on the various tasks and duties assigned to this individual.
- In the event that floor staff must use the restroom facilities and cannot wait until their scheduled break, they must notify another staff member that they will be off the floor. If another staff member is not available to monitor the floor, the doors must be momentarily locked while they use the restroom. Leaving the floor unattended (with or without the presence of customers in the store) is not permissible.
- Rest breaks should be taken alone, and never scheduled to coincide with the breaks of other staff members.
- In the event that you are on break and in the proximity of other employees who are currently on shift, ensure that you do not talk to/distract them from performing their duties.
- Likewise, if you are currently on shift, you are expected to maintain focus on your tasks. If other staff members are distracting and preventing you from performing tasks at your peak speed & accuracy level, it is your responsibility to kindly inform them (or remove yourself from the situation).
- Smokers & vapers are not entitled to additional rest breaks, and are expected to restrict all smoking to their designated 10 minute rest periods as allotted by State regulations. Within the 10 minute period, smokers must account for the time to freshen up and remove any odors before returning to work. Smoking/vaping is only permitted in designated areas (not within 10 feet of building entrances, exits, windows, accessibility ramps or air intake vents).
| Length of work period | Number of rest breaks required | Number of meal periods required |
| 2 hrs or less | 0 | 0 |
| 2 hrs 1 min – 5 hrs 59 min | 1 | 0 |
| 6 hrs | 1 | 1 |
| 6 hrs 1 min – 10 hrs | 2 | 1 |
| 10 hrs 1 min – 13 hrs 59 min | 3 | 1 |
